Requirements:

 

All Mississippi companies with 5 or more employees are required to buy a workers’ compensation policy.

If the company has less than 5 employees, then workers compensation is not required but the business owner can voluntarily purchase a work comp policy.

Sole Props, Partners & LLC Members are automatically excluded from a policy, but may elect to be included on a workers comp policy.

Sole Proprietors & Partners who included themselves on a policy must use a $36,600 minimum payroll (as of January 1, 2017).

Corp. Officers are included on a workers comp policy, but may elect to exclude themselves from coverage.

Corporate Officers and LLC Members who are included on a policy must use a payroll amount no less than $700 per week and no more than $2,300 per week (as of 3/1/2017).

Mississippi independent contractors are excluded from work comp coverage. Special protection is given to employees of subcontractors.
