Requirements:

 

All South Dakota companies are required by law to buy a Workers’ Compensation policy.

Sole-Props & Partners are automatically excluded from coverage, but they can choose to be included on a policy.

Corporate Officers & LLC Members are included on a workers compensation policy, but they may choose to be excluded.

Sole-Props & Partners who opt to include themselves on a policy in South Dakota must utilize a $38,100 payroll amount for premium calculation purposes.

Officers & Limited Liability (LLC) Members who are not excluded from coverage must use a $39,000 minimum payroll and a maximum $150,800 payroll for the purpose of calculating workers compensation insurance premium.
