All West Virginia companies are required to carry workers compensation insurance.

Sole Proprietors, Partners, Corp Officers and LLC Members are automatically included on a workers comp policy, but may opt to be excluded.
Sole Proprietors & Partners must utilize a $40,900 minimum payroll (accurate as of January 1, 2017).
West Virginia LLCs may choose to exclude themselves from a workers comp policy as long as they are serving as a manager, officer or LLC Member.
Corporate Officers & LLC Members included on a policy must use a $41,600 minimum payroll and a $161,200 maximum payroll (accurate as of January 1, 2017).
